At FairPlay™ AI, Inc. (“FairPlay,” “we,” “us,” “our,”) we recognize the importance of privacy.  In this privacy policy (the “Privacy Policy”), we describe how we collect, use, and disclose information that we obtain from visitors to the subdomains and websites on www.fairplay.ai, www.fairplay.ai and www.fairness-asa-service.com (the “Sites”) as a business. We may collect this information when you contact us to obtain more information or a demo, or directly through your use of our online platform and services (“Services”). A reference to “FairPlay™ AI,” “FairPlay,” “we,” “us,” or “our” is a reference to FairPlay™ AI and its relevant affiliates involved in the collection, use, sharing or other processing of personal information. 

THIS PRIVACY POLICY DOES NOT APPLY TO CONSUMER PERSONAL INFORMATION THAT WE RECEIVE FROM OUR CORPORATE CUSTOMERS IN CONNECTION WITH OUR FAIR LENDING ANALYTICS SERVICES.  WE PROCESS THAT DATA IN OUR CAPACITY AS A SERVICE PROVIDER PURSUANT TO SEPARATE CONTRACTUAL TERMS WITH OUR CORPORATE CUSTOMERS.

By visiting the Sites, you agree that any information that we collect from or about you through the Sites, including Personal Information, anonymous information, and aggregate information (collectively, “Information”), will be handled as described in this Privacy Policy.  We define “Personal Information” as personally identifiable information about an individual person, such as a name, address, email address, phone number, or other identifier that permits contacting of a specific individual, or such other definition that applies under applicable privacy laws.

Your use of the Sites and any dispute over privacy, is subject to this Privacy Policy which is incorporated via reference into our Terms of Use (the “Terms”), including the applicable limitations on damages and the resolution of disputes set forth therein.  Capitalized terms not defined herein are as defined in the Terms.

Our Sites may contain links to and from the websites of third parties. If you follow a link to any of these websites, please note that these websites have their own privacy policies, and we do not accept any responsibility or liability for these policies. Please check these policies before you submit any information to these websites. 

1. Personal Information We Collect.  

We collect Information directly from you, from third parties, or automatically through your use of the Sites.  We may combine Information collected through the Sites with Information provided through other sources (e.g., trade shows, conferences, market intelligence platforms, publications, and academic resources). 

  • Information we Collect Directly from you.  We will collect any Information that you choose to provide to us through the Sites, such as your name, email address, account credentials, the contents of any message submitted through the “Contact Us” feature of the Sites, and the contents of your resume and job application if you apply for a job through the Sites.
  • Information we Collect Automatically.  We automatically collect Personal Information through your use of the Sites using cookies and other technologies, like most other web-based services.  This Information may include, without limitation, information about your operating system, settings and system configurations, IP address, device model, device ID and other unique device identifiers, browser type, browser version, the webpages you access within our Sites, the website that led you to the Sites, the website to which you go after leaving the Sites, links you click within the Sites, the dates and times you access the Sites, event information (e.g., system crashes), web log data, and whether you reached our page via a social media or email campaign. This data may be collected via several technologies, including cookies, web beacons, clear GIFs, canvas fingerprinting and other means, such as Google Remarketing and Facebook Pixel. You can control cookies in your browser to enable or disable them. 

If you access our Sites through third parties (e.g., Facebook or Google), or if you share content from our Sites to a third-party social media service, the third-party service will send us certain information about you if the third-party service and your account settings allow such sharing. The information we receive will depend on the policies and your account settings with the third-party service.  

  • Aggregated Data. We may aggregate or otherwise strip information of all personally identifying characteristics (“Aggregated Data”).   Aggregated Data may be derived from your Personal Information but is not Personal Information.  For example, we may aggregate Site usage data to calculate the percentage of users accessing a specific Site feature.  We reserve the right to make use of any such Aggregated Data as we see fit. 

2. How We Use Your Information.  

We use Information, including Personal Information, for the following purposes:

  • Providing the Sites, which includes:
    • providing customer service; 
    • processing and fulfilling orders and transactions; 
    • verifying customer information; and
    • providing advertising and marketing services to you.  
  • Analyzing Use of the Site.  This may include analyzing customer usage and improving services offered. 
  • To Conduct Market Research. This may include conducting market research and project planning. 
  • To Detect Security Incidents. This may include detecting against security incidents, protecting against fraudulent or other criminal activity, debugging and repairing errors, and maintaining the overall quality of our Sites.  
  • To Fulfill Obligations. This may include fulfilling our legal and financial obligations. 

3. How We Share Your Information.  

We may share Information, including Personal Information, with the following entities:

  • Affiliates, Service Providers, and Subcontractors.  We may share your Personal Information with our third-party service providers, affiliates, and any subcontractors as required to offer our Sites. These entities help us to:
    • Run, operate, and maintain our Sites through third-party platforms and software tools; 
    • Perform content moderation and crash analytics; 
    • Perform marketing analytics; 
    • Provide measurement services and targeted ads (you can opt out of these services at websites such as http://www.aboutads.info/choices and http://www.youronlinechoices.eu/); and
    • Provide technical and customer support. 
  • Third Party Marketing and Advertising Cookies. With respect to website cookies, we may share your information with third-party marketing and advertising partners to market our Services on our Sites, on other websites you may visit, or to your home address.
  •  Third Party Direct Marketing. If you are one of our customers, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your Personal Information to third parties for the third parties’ direct marketing purposes. To make such a request, please contact us using the “Contact Information” below. 
  • Disclosures Required by Law. We may be required to disclose your Personal Information in response to lawful requests by public authorities, including to meet law enforcement requirements. We may be under a duty to disclose or share your Personal Information to comply with any legal obligation, to enforce or apply our Terms or other agreements, to protect our rights, property, safety, or to protect the rights, property or safety of others. This includes exchanging data with other companies and organizations for the purpose of fraud protection. 

4. How We Respond to ‘Do Not Track’ Signals. 

Some browsers provide you with a way to signal that you do not want your browsing activity to be tracked. The Sites may not currently respond to all Do Not Track (“DNT”) or similar signals, as we are awaiting consensus from the Internet policy and legal community on the meaning of DNT and the best way to respond to these signals. 

5. Cookies.  

We and our service providers use cookies and other tracking mechanisms to track your use of the Sites and to help make our Sites work properly. We or our service providers may use cookies to track visitor activity on the Sites such as the pages visited and time spent on the Sites.  A cookie is a text file that a website transfers to your computer’s hard drive or mobile device when you visit the site for record-keeping purposes. It enables the website to remember actions and preferences over a period of time, so you do not have to keep re-entering them when you come back to the Sites or browse from one page to another. 

You may wish to restrict the use of cookies. Most browsers allow users to refuse cookies.  The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether.  Visitors to the Sites who disable cookies may not be able to browse certain areas of the Sites, and some features of our Sites may not function properly.

6. Security.  

We have taken steps to help protect the Personal Information we collect about you from loss, misuse, unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no data security measures can guarantee 100% security.  Thus, while we have established and maintain what we believe to be appropriate technical and organizational measures to protect the confidentiality, security, and integrity of information obtained through the Sites, we cannot ensure or warrant the security or any information you transmit to us. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

7. Children’s Privacy.  

Our Sites are not targeted to children under sixteen (16) years of age.  We do not knowingly collect Personal Information from anyone under the age of sixteen (16). If you become aware that a child has provided us with Personal Information, please contact us using the details provided at the end of this Privacy Policy. If we discover that a child under sixteen (16) has provided us with Personal Information, we will take steps to promptly delete such Personal Information from our systems. 

8. Change of Control. 

Personal Information may be transferred to a third party because of a sale, acquisition, merger, reorganization, or other change in control. If we sell, merge or transfer any part of the business, part of the sale may include your Personal Information.

This Privacy Policy is current as of the effective date set forth above.  We may change this Privacy Policy from time to time by posting an updated version to the Sites, so please be sure to check back periodically.  If we make any changes to this Privacy Policy that materially affect our practices with regard to the Personal Information we have previously collected from you, we will endeavor to provide you with notice in advance of such change by highlighting the change on the Sites.  Please review carefully before submitting Personal Information to our Sites.
